IRAN HAS LAUNCHED a frantic flurry of initiatives in the past two weeks, most of them bellicose — from suspending oil shipments to Europe to allegedly attempting to assassinate Israeli diplomats. But the Obama administration and its allies appear likely to seize on Tehran’s contrasting dispatch of a 200-word letter agreeing to a renewal of talks on its nuclear program. Delivered at a moment when sanctions appear to be causing severe disruption to the Iranian economy, the offer raises the hope that the theory underlying years of U.S. policy — that international pressure would eventually cause Iran’s current leaders to bargain seriously — could at last be proved. It will, at least, be put to a crucial test.

However, the 99% Movement was conceived exactly two years ago, with the release of an online report and call to action titled "The Economic Elite Vs. The People of the United States of America." The report was originally released as a six-part series. The first part was published on February 15, 2010 and the last part was published on February 27, 2010.

Aftermath of the Police Raid on #OccupyOakland

This seven-minute video gives a pretty good brief impression of what happened in Oakland yesterday, following the police destruction of the Occupy Oakland encampment at Frank Ogawa Plaza. Among other things, I call your attention to a poignant interaction around 4:45 where a few marchers start pushing a dumpster, as if to start a barricade. A guy hugs one of them and pleads with them, “Oh, no, guys, come on, let’s be civil.” One of the others says, “Are they [the police] being fuckin’ civil?!” Hugging that second guy, he says, “I know, brother, they’re savages, they’re fuckin’ savages. But don’t be like them! Don’t be like them!” If you think that rhetoric is excessive, note the very end of the video, where lots of people are running away and one of them is hit by a tear gas canister and falls to the ground. Several of the others run back to help him, and as they are all crowding around, the police throw a flash-bang grenade right down into the group which explodes in the injured man’s face. Here is a clearer view of the same incident. The young man, an Iraq war veteran, has a fractured skull and is in critical condition. But I guess this sort of thing has to be done in order to maintain “public peace” and keep the Plaza nice and “hygienic” . . .

Senate panel votes, 11-7, to open Supreme Court to cameras

The Senate Judiciary Committee voted, 11-7, Thursday morning for legislation that would open Supreme Court arguments to television coverage.

The vote was largely along party lines. The only Democrat to oppose the measure was Sen. Dianne Feinstein of California, who said she feared showboating by lawyers and a slippery slope leading to a reprise of the O.J. Simpson murder trial. Other senators noted that televising trial court proceedings, while common in many states, is a more complicated matter than televising Supreme Court arguments, where there are no witnesses or juries.

Two Republicans with a history of supporting transparency measures voted for cameras, Sens. Chuck Grassley of Iowa and John Cornyn of Texas.

The bill has a provision which would allow a majority of justices to close arguments in a specific case if due process required it. Many justices have resisted opening the court to cameras, though they now release audio recordings of arguments.

One side note: after Simpson's acquittal in 1995, the Clinton White House considered endorsing legislation to ban or limit camera coverage in trial courts. It never formally endorsed such a measure, which could raise constitutional questions by regulating state court proceedings.

Wikileaks' suspect Bradley Manning's arraignment set for Feb. 23

Army Pfc. Bradley Manning, the intelligence analyst accused of leaking hundreds of thousands of classified diplomatic cables and military reports to WikiLeaks, will be arraigned before a military judge on Feb. 23, the military said Thursday.

Manning is charged with aiding the enemy, disclosing classified information to a person not authorized to receive it, violating various Army rules related to computer use, and other violations. He faces the possibility of life imprisonment if convicted on the aiding the enemy charge.

Another military lawyer, acting as an official investigator, held a preliminary hearing for Manning in December. That investigator, Lt. Col. Paul Almanza, approved all of the military's tentative charges in the case without any alteration despite defense requests to streamline the charges. Last week, Maj. Gen Michael Linnington ordered that Manning be referred to a court martial.

An Army spokesperson declined Thursday to identify the judge who ordered and will conduct the arraignment, which is to be held at Ft. Meade, Md., the same site where Manning's so-called Article 32 hearing took place. The judge will be identified at the arraignment, the spokesperson said.

Ex-CIA officer may be exploring guilty plea in leak case

A former CIA officer charged last month with leaking the identities of other CIA officers involved in the interrogation of terrorism suspects may be exploring the possibility of entering a guilty plea in the case, court records suggest.

John Kiriakou, 47, was accused of the leaks in a criminal complaint filed in federal court in Alexandria, Va. on Jan. 23. He surrendered and was released on bond the same day.

Normally, prosecutors have 30 days to obtain a grand jury indictment after filing a complaint. However, on Tuesday, the government and Kiriakou's defense attorney, Plato Cacheris, filed a joint motion seeking to extend that deadline until April 7.

"Defense counsel has requested the opportunity to discuss the case with the government after reviewing the matter in greater depth and prior to an indictment being filed. The government does not object to a modest delay for this purpose," the motion said.

The motion contained no mention of plea discussions, but such extensions are often sought to accomodate plea negotiations. While a guilty plea can be negotiated after an indictment is returned, prosecutors often prefer to do so before indicting a suspect, since the indictment and ensuing motions can put evidence in the public record that the government might prefer to keep under wraps. That desire is often particularly intense in espionage and intelligence-related cases.

The motion filed Tuesday indicates that prosecutors plan to provide some classified information to the defense before an indictment is filed. There is little reason to do that except to try to induce the defendant to enter a guilty plea. "The government anticipates providing certain limited pre-indictment discovery once defense counsel obtains the requisite security clearances," the motion said.

Cacheris did not return a phone call and e-mail message seeking comment for this post.

The case against Kiriakou is being prosecuted by lawyers from the office of the U.S. Attorney in Chicago, Patrick Fitzgerald, who was appointed to investigate the matter because of a potential conflict of interest at the Justice Department's National Security Division, which is involved in making prosecution decisions about the terror suspects involved in the interrogations.

A spokesman for Fitzgerald declined to comment on Tuesday's filing or any possible plea talks.

Split verdict in China-linked case

A federal judge in Chicago has convicted a Chinese-born naturalized American of three counts of stealing trade secrets, but acquitted her on three more serious charges of economic espionage on behalf of China's government and military, the Justice Department announced.

Hanjuan Jin, 41, heard the verdicts on Wednesday from U.S. District Judge Ruben Castillo. Jin, was accused of stealing mobile phone design information from her then-employer, Motorola, after she was detained at Chicago's O'Hare airport while trying to fly to China in 2007 with more than $31,000 in cash and more than 1000 Motorola documents.

Jin waived her right to a jury trial and elected a so-called bench trial before Castillo. Defense lawyers sometimes make such a move when they believe the overtones of a case might lead a jury to convict even if the evidence is lacking.

Second South Park threats suspect to plead guilty

A second man alleged to have made illegal threats against "South Park" creators Trey Parker and Matt Stone has agreed to plead guilty, according to a defense lawyer.

Jesse Morton, also known as Younus Abdullah Mohammad, was detained in Morocco last May in connection with alleged threats posted on the Revolution Muslim website after "South Park" depicted Mohammad as a man in a bear suit. Prosecutors allege that Morton helped write a "clarification statement" that amounted to a further threat against the "South Park" creators by praying for their deaths and suggesting that they were likely to face the violent demise of other critics of Islam.

Some Muslims view any visual depiction of Mohammad as offensive. The "South Park" episode was considered a commentary on an earlier controversy over a Danish newspaper's publication of cartoons of the Muslim prophet.

Morton was transferred to U.S. custody in Rabat in October and returned to the U.S. later that month.

A lawyer for Morton, James Hundley, said his client plans to appear in federal court in Alexandria, Va. on Thursday to plead guilty to three felonies: conspiracy, communicating threats, and internet stalking. Each carries a sentence of up to five years in prison.

A spokesman for the U.S. Attorney's Office in Alexandria had no immediate comment on the development.

Hundley said the case against Morton presented free speech issues, but his client ultimately decided to take the plea the government offered rather than risk trial on more serious charges that could carry an even longer sentence.

"Certainly, this case had that question: at what point are you exercising free speech and at what point are you verging into prohibited speech of a threatening or inciting nature?" Hundley told POLITICO Wednesday. "That was something we obviously looked at very closely."

"If [Morton] had rejected the plea offer, he'd be facing substantially more than 15 years," Hundley said.

In February, another man who worked on the "Revolution Muslim" website with Morton, Zachary Chesser, was sentenced to 25 years in prison for his role in the threats against Parker and Stone, as well as efforts to plant abandoned packages in public areas to divert emergency responders.

"Revolution Muslim," a site Morton helped found, became a font for radical Islamic propaganda but also a useful tool for law enforcement trying to track potential jihadists in the U.S. and abroad, according to an NPR report in 2010.

5:59 PM PT: Regarding Mitt Romney, the morning after pill, and Catholic hospitals, here's a flashback:

ov. Mitt Romney abandoned plans Thursday to exempt Roman Catholic and other private hospitals from a new law requiring them to dispense emergency contraception to rape victims.

Romney had initially backed regulations proposed earlier this week by his public health commissioner, Paul Cote, who said the new law conflicted with an older law barring the state from forcing private hospitals to dispense contraceptive devices or information.

The Republican governor, who is considering a run for president in 2008, said at a news conference Thursday morning that he asked his legal advisers to review the matter after members of both parties criticized the regulations. He said the lawyers determined that the new law superseded the old law and that all hospitals should be required to offer the so-called "morning-after pill."

"On that basis I have instructed the Department of Public Health to follow the conclusion of my own legal counsel and to adopt that sounder view," Romney said.

"I think it's, in my personal view, it's the right thing for hospitals to provide information and access to emergency contraception to anyone who is a victim of rape," he added.
